• In a lesbian adoption involving two women, the woman who receives the insemination and carries the child to term can consent to allow her partner to adopt that child through a second parent adoption proceeding.
• When a gay male couple adoption is taking place that involves using a gestational surrogate and an egg donor, we can first go to court pre-birth to release the legal parental rights of the egg donor and gestational surrogate and establish the genetic father as the sole legal parent. Upon birth of the child, the genetic father will be recognized as the birth parent and the partner can then adopt the child through a second parent adoption.
