Whose insurance will pay for the medical costs involved?

We will do a thorough evaluation of health related issues and provide referrals to appropriate health insurance carriers that are willing to pay for the prenatal care and delivery for the surrogate mother in this arrangement.

Who will be recognized as the legal parent of this child?

We will perform the court work necessary to establish parental rights by obtaining a legal declaration of parentage. In many situations, this can be done while the child is still in the womb. We will evaluate your precise situation and help provide the guidance as to the timing as to when it is best to proceed in court and establish parental rights.

What are the monetary obligations and legal responsibilities of each party?

The rights and responsibilities of each party must be set forth in an individualized and detailed contract whereby all parties come to an agreement. You can count on us to ensure this is done properly, leaving no question as to the intent of each party in relation to these legal matters and minimizing the risk of future conflicts arising. We will work with and advise all parties involved regarding the legal and financial implications of these various arrangements, including:

• Traditional surrogacy – artificial insemination using surrogate’s eggs and semen from intended father or from a donor
• Gestational surrogacy – utilizes in-vitro fertilization where a non-biologically related embryo is medically implanted in the surrogate’s uterus. Intended parents can have a child that is genetically related to them, using the intended mother’s egg and intended father’s sperm or alternatively a child that is genetically related to only either the intended mother or intended father.
• Semen donation - sperm donated by a man with the intention that it be used to achieve a pregnancy in a woman who is not the man's sexual partner
• Ova donation - the process by which a woman donates her eggs for purposes of assisted reproduction
• Embryo donation - semen and egg material from an outside source are donated for the goal of producing a successful pregnancy for the recipients.
